A Bengaluru household may have its most important financial records scattered across an employer portal, a home-loan account, a demat account and a property file kept in another city. Estate planning needs to bring those records together and explain who can act when the usual decision-maker cannot. A will is important, but a period of incapacity following illness or an accident creates a different set of immediate questions.

Map the apartment, the debt and the ownership share

Begin with the sale deed, co-owner details, home-loan terms and relevant property records. An apartment described as the family home may be owned by one spouse, both spouses in specified shares, or another family member. The estate plan should reflect the legal position rather than who usually pays the maintenance bill. For land to which RTC records apply, the Bengaluru Urban district’s Bhoomi guidance describes the land-record and mutation system. Do not assume that an RTC is the correct document for every urban apartment or that a municipal record alone establishes title. Identify the records applicable to the particular property and reconcile names, identifiers and earlier transfers before drafting a gift in a will or settling an interest into trust.

Employee equity requires a separate review

For a professional with employee shares, options or other deferred compensation, collect the plan rules and statements rather than putting a guessed value in the asset schedule. Distinguish an option from shares already acquired, vested rights from unvested awards, and company ownership from employment benefits. The governing documents may restrict transfer or specify what happens on death or termination. A will cannot create a transferable right where the plan does not provide one. A trust should not be funded with an assumed asset before the issuer’s rules and any necessary consent are reviewed. Record the employer’s contact process and the documents a family would need to obtain information, while keeping login credentials outside the publicly shared planning file.

Write a will that remains useful as assets change

A Bengaluru will should identify the testator’s wishes, executor, beneficiaries and substitutes, while accounting for the person’s applicable succession law. A residuary provision helps address assets not specifically listed, but it cannot fix every ambiguity about ownership or conflicting documents. Describe major property interests accurately and review the document when the family’s circumstances change. For an ordinary unprivileged will to which section 63 of the Indian Succession Act applies, signature and witness requirements must be satisfied. Choosing a beneficiary or their spouse as a witness can create avoidable legal complications, so obtain advice on appropriate witnesses. Registration is generally optional; it does not replace sound execution, capacity or freely given instructions.

Plan for temporary absence and prolonged incapacity separately

A work trip, inability to travel after surgery and loss of decision-making capacity are different events. A limited power of attorney may assist a capable person with a specific transaction, subject to the necessary formalities. It should be reviewed for the intended bank, property or institutional use rather than treated as a universal permission slip. Where mental incapacity is anticipated, ordinary agency has limits under section 201 of the Indian Contract Act. A diagnosis or physical limitation should not automatically be equated with that legal condition. Build an arrangement that respects the person’s retained abilities and identifies who may act for each asset if those abilities are insufficient for the task.

A living trust may help when administration is continuing

A funded private living trust can provide ongoing management for specified assets, with rules for the settlor’s maintenance and other beneficiaries. It may be worth considering where dependent children, a vulnerable family member, complex holdings or an extended period of care require more than a one-off delegation. Trustees need identifiable powers, duties and replacement provisions. A trust does not automatically take control of a Bengaluru apartment merely because the deed mentions it. Sections 5 and 6 of the Indian Trusts Act require careful attention to constitution and property, and relevant registration and stamp requirements must be addressed. Obtain an asset-by-asset feasibility and cost review before deciding which holdings, if any, should enter the structure.

Cross-border families need coordinated instructions

If one spouse works overseas or the family owns assets outside India, record asset location, citizenship and residence as separate facts. A foreign document called a durable power or revocable trust should not be assumed to produce the same result for Indian property. Conversely, an Indian will may need coordination with documents governing foreign assets. Where separate wills are used, careless revocation wording can cause one to undermine another. Obtain advice in the relevant jurisdictions before signing. Review foreign-exchange, tax and institutional requirements before introducing overseas trustees, beneficiaries or investments into an Indian structure. The objective is consistent authority across the actual holdings, not a document claiming universal effect without the necessary legal support.

Provide accessible money for the household

Consider a hypothetical Bengaluru couple with a mortgaged apartment and two young children. Most investments are held in one partner’s name, while household payments are automated from that partner’s account. A serious accident interrupts instructions. A high net worth does not guarantee that the other partner can lawfully operate every account or redeem investments. Prepare a realistic care and household budget, identify an appropriately accessible reserve, and document account mandates with the institutions. Do not rely on sharing passwords as the estate plan. A trustee may administer properly settled assets, but excluded holdings still need consideration. Budget for school expenses, insurance and debt servicing as well as immediate treatment costs.

Match responsibility with safeguards

If a trustee or executor lives abroad, ask how they will perform the work, communicate with institutions and obtain documents. A locally available helper may be valuable, but that helper needs defined authority. Build a replacement process and clear rules for routine payments, major disposals and conflicts involving family members. For incapacity triggers, identify an appropriate evidentiary process, protection against opportunistic control and a route for reassessment if the person recovers. Physical disability should not automatically strip someone of participation. Reporting, separate accounting and documented decisions help the arrangement remain trustworthy over time. Ask each proposed office-holder whether they understand and accept the practical role.

Keep medical wishes and property decisions coordinated but distinct

A living will or advance medical directive addresses treatment choices under the applicable legal framework; a living trust deals with assets. The similar terminology can mislead families. A financial trustee’s ability to pay for care does not by itself confer medical decision-making authority. Discuss treatment preferences separately with suitable professional advice and make relevant documents available to the appropriate people.
