The 10-year term and the renewal window
A registered trademark is protected for 10 years from the application date. Before that term ends, the owner may renew for another 10 years by paying the official renewal fee. If the mark is not renewed, there is a further grace period of six months during which it may still be renewed by paying, in addition, a late fee.
The grace period and restoration
If the renewal and grace period are missed and the mark is removed, the owner is not automatically out of luck. Under the Trade Marks Act, 1999, the Registrar may restore a removed trademark if certain conditions are satisfied, including prompt application and satisfaction that the removal is not contrary to the interests of other persons. Restoration is not guaranteed, so acting quickly and correctly matters.
